The Yukon Water Board is guided by acts, regulations and agreements that inform its function in the water licensing and Class 4 placer land use operation approval processes:

 

  • The Waters Act and Waters Regulation maintains the Yukon Water Board as the sole regulator for the use of water and deposit of waste into water. By wat of a delegation from the Government of Yukon, the Board issues, renews, amends, cancels and assigns water licences pursuant to this legislation.

 

  • The Board is delegated by the Government of Yukon, certain functions of the Chief of Placer Land Use respecting Class 4 placer land use operations. The Placer Mining Act and Regulation guide the Board's consideration, as Chief, of these applications.

 

  • Chapter 2 and Chapter 14 of the Yukon First Nations' Final Agreements further define the Board's role as a regulator of water in Yukon and its obligation and responsibilities that relate to water rights and interests of Yukon First Nations and Yukon Indian Persons.

 

  • The Board's obligations under the Yukon Environmental and Socio-Economic Assessment Act restrict issuance of a water licence or Class 4 placer mining land use approval prior to, or contrary to, the issuance of a Decision Document.
